Release of Liability, Assumption of Risk, and Indemnification Agreement
This Document affects your legal rights. Read it carefully before signing.

RELEASE AND WAIVER STATEMENT: I, the undersigned participant, for myself and those persons included in this registration, fully release, discharge and hold harmless the Trails and Open Space Coalition, Garden of the Gods Visitor and Nature Center, sponsors and all persons and agencies connected with this event from any and all liability, whether resulting from negligence of any aspect of the Starlight Spectacular event.

 

I certify and represent by my application for entry that my physical condition is adequate to compete safely in the Starlight Spectacular. In the event I receive medical care as a result of a medical emergency, I hereby consent to such care and fully release the person(s) providing such care from any and all liability, whether resulting from negligence or otherwise. I authorize and consent to the publication, whether by videotape, film, newsprint, written advertisement or otherwise, of any materials containing my name or picture, and I release any sponsors and all persons acting under authority from any claims I might have for subsequent publications. I hereby opt in to email communications from Trails and Open Space Coalition, with the understanding that my email address will never be sold or shared, and that I may opt out at any time. I hereby certify that I have fully read and understand the foregoing release, waiver and covenant not to sue and sign it knowingly, willingly and voluntarily.

 

I agree to wear a helmet at all times and to equip my bicycle with working lights at all times during the ride. All riders under 18 must be accompanied by an adult. Riders MUST wear helmets and have front and rear lights to participate. Carry ID!

 

I understand this is a charity event benefiting the Trails and Open Space Coalition and there will be no refunds on registration fees for any reason.

 

The safety of our participants, volunteers, and staff is the most important thing and if any of the threatening weather conditions (including Tornado Warning, Tornado Watch, Thunderstorm, Lightning, Excessive Wind with Rain, Hail, or other major weather condition not listed) are present the day of the event, the event may be canceled. When weather conditions or other physical conditions present a danger to participants, Trails and Open Space Coalition maintains the right to cancel the event. Less threatening conditions may cause alterations of the course or the post-race festivities to ensure participant, volunteer, and community safety. Such conditions fall under the label “Acts of God,” and will not result in refunding of any race entry fees or future event credits.

*If participant is under 18 years of age, signature of parent or responsible adult is required above. In consideration of the minor child being permitted to participate in the Activity, I accept and agree to the full contents of this agreement. I certify that I have the authority to sign on behalf of the minor child and to make decisions for the minor child regarding this Activity. I also agree to RELEASE, HOLD HARMLESS, INDEMNIFY AND DEFEND the Released Parties (as defined herein) from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs to the minor child during the Activity or in any way related to the Activity. This includes any claim of the minor and any claim arising from the negligence of the Released Parties. I understand that nothing in this agreement is intended to release claims any liabilities that governing law does not permit to be excluded by agreement.
